Family Law Expertise and Advice

about Same Sex Relationship disputes

The Marriage Amendment (Definition and Religious Freedoms) Act 2017 took effect once same-sex marriage was officially declared legal in Australia. The Act revised the Marriage Act 1961 by redefining marriage as “the union of 2 people to the exclusion of all others” instead of the union of “a man and a woman.”

The Migration Act of 1958 permits Australian citizens to bring their families to Australia through the family migration stream. Spouses, fiancés, and de facto partners are just a few of the qualified applicants. Before 2017, same-sex partners had to request an interdependency visa with stringent rules and norms compared to partner or spousal visas.

The recent migration pathways for visa applications in same-sex relationships can be quite intricate, particularly when finding the requirements of lodging partner visas. As the migration law keeps changing often, it is essential to find advice from one of our legal experts before initiating any visa application.

At FCL Lawyers, we take extra measures in assisting same-sex couples to overcome any difficulties to be lawfully married and to guide you in any other areas of family law.

With the legalisation of same-sex marriages, those that have been solemnised in a jurisdiction outside Australia are now accepted irrespective of the time of the marriage. Hence, same-sex couples married abroad are consequently considered legally married in Australia.

FAQ’s

Common FAQ’s
Questions you
may have about
Family Law

What are the upfront costs to deal with your matter. Which court is applicable for the matter. Will I be eligible for child support and spousal maintenance?
Depending on your situation, there are several family law arrangements, e.g., Binding Financial Agreements (BFA), Consent orders, parenting orders, Deeds of family arrangement, etc.
Child support payments of one parent to the other depend on various factors such as the combined income of both parents, income percentage, percentage of care of children, etc. You may discuss your situation with our lawyers or verify the child support payment through the Services Australia website.

Divorce matters can be complicated unless it is an amicable divorce with no children. Your rights depend on when you were separated (even if you lived under the same roof), whether children are involved, and property and financial matters. We encourage you to contact our Lawyers before deciding on applying for a divorce.

Separation and divorce matters can be strenuous and time-consuming, especially when there are children under the age of 18 involved. Denying access to your child may seem like a difficult decision, but the child’s best interest must be the paramount consideration in those decisions. Generally, denying access to a child in Australia is not allowed; however, in extreme circumstances, in order to protect the child’s safety, especially where there is a history of violence present, drug or alcohol abuse is involved or where one parent may have severe mental health issues.
Access to a child may depend on the conditions specified by the court n the Intervention order; unless the order allows for communications with you, you and the affected family members included in the intervention order are protected by law. Please get in touch with our Lawyers immediately to assess your situation and the protection mechanisms.
