A legal separation encompasses both a belief and physical viewpoints. For separation to be legalised, at least one of the partners must be sure that the marriage has ended.
Physically, a separation is considered when a couple has ended their relationship as a husband and wife. Generally, this involves living in separate houses and completing daily social interactions. However, if they have children, there would be constant contact, but only as their roles as parents. Likewise, the couple may choose to remain friends and see one another.
Some couples may even continue living in the same house after they have separated. In such cases, the Court will require some validation, typically from a friend or relative, regarding involving matters such as separate bedrooms, less social contact, and that separation has been publicised.
