about Separation and Divorce

A legal separation encompasses both a belief and physical viewpoints. For separation to be legalised, at least one of the partners must be sure that the marriage has ended.

Physically, a separation is considered when a couple has ended their relationship as a husband and wife. Generally, this involves living in separate houses and completing daily social interactions. However, if they have children, there would be constant contact, but only as their roles as parents. Likewise, the couple may choose to remain friends and see one another.

Some couples may even continue living in the same house after they have separated. In such cases, the Court will require some validation, typically from a friend or relative, regarding involving matters such as separate bedrooms, less social contact, and that separation has been publicised.

What questions should I ask my family lawyer?

What are the upfront costs to deal with your matter. Which court is applicable for the matter. Will I be eligible for child support and spousal maintenance?

Depending on your situation, there are several family law arrangements, e.g., Binding Financial Agreements (BFA), Consent orders, parenting orders, Deeds of family arrangement, etc.

Child support payments of one parent to the other depend on various factors such as the combined income of both parents, income percentage, percentage of care of children, etc. You may discuss your situation with our lawyers or verify the child support payment through the Services Australia website.

Divorce matters can be complicated unless it is an amicable divorce with no children. Your rights depend on when you were separated (even if you lived under the same roof), whether children are involved, and property and financial matters. Separation and divorce matters can be strenuous and time-consuming, especially when there are children under the age of 18 involved. Denying access to your child may seem like a difficult decision, but the child’s best interest must be the paramount consideration in those decisions. Generally, denying access to a child in Australia is not allowed; however, in extreme circumstances, in order to protect the child’s safety, especially where there is a history of violence present, drug or alcohol abuse is involved or where one parent may have severe mental health issues.

Access to a child may depend on the conditions specified by the court n the Intervention order; unless the order allows for communications with you, you and the affected family members included in the intervention order are protected by law.
